We signed a retail leasing listing agreement for a 17,000sf space in Laguna Niguel with the President, Alexander Ghatan. Throughout the multi-month listing, he did no advertizing, no signage, etc. He did not show the unit even once. But this is not the bad part; when we cancelled the listing, he gave us a list of dozens of retailers that if we leased to we would end up owing him a commission. We proceeded to lease the unit to someone else (not on his list). He then came back to both us and our new tenant demanding to know when we first contacted each other, etc., so that he could figure out whether he could get a commission. He did not believe us that the tenant contacted me after the listing expired so now he has threatened legal action to get more information, saying he just had to sue a landlord for a commission and was planning to do the same to us. Be careful to have your attorney review any agreement you make any agreement with this company and make it as short as possible, taking out the automatic renewal provision. Good luck!
